Partner programme terms
Version of 31 October 2026. In case of discrepancy, the French version prevails.
These terms govern the Merkatis Monitoring partner programme, a service published by Merkatis. The partner accepts them when submitting its application.
1. Purpose
The partner introduces Merkatis Monitoring to its clients and prospects. In return, Merkatis pays it a commission on the amounts collected from the customers it has brought in.
2. Application and approval
Any company or independent professional may apply. Merkatis accepts or rejects applications at its sole discretion, without having to give reasons, although it endeavours to do so. Merkatis may suspend or end a partner's participation at any time, in particular if these terms are breached.
3. Attribution of a customer
A customer is attributed to the partner when it creates its account within 60 days of first following the partner link. Following the link is only recorded if the visitor has accepted campaign measurement in the website's consent banner. When a customer has followed the links of several partners, the first link followed prevails. Merkatis may also manually attribute a customer who is not yet attributed to any partner, upon a justified request.
Attribution is final: a customer attributed to a partner does not change partner. A partner cannot be attributed its own account or that of an entity it controls. Attribution is internal information: it gives the partner no access to the customer's data (see article 7).
4. Commission
The commission is 25% of each amount collected by Merkatis from the attributed customer, excluding taxes, net of refunds and credit notes: subscriptions as well as one-off services invoiced separately (expert interventions, specific quotes). It is due for as long as the attributed customer's account remains active.
5. Statement, invoicing and payment
Each month, the platform issues a statement of the commissions for the previous month. The partner issues its invoice on the basis of this statement. Merkatis pays it by bank transfer to the registered IBAN, within 30 days of receipt.
When the amount for the month does not reach €100 excluding taxes, it is carried over to the following month, and so on until this threshold is reached.
Any change of IBAN suspends payments until Merkatis has verified it.
6. Partner's undertakings
The partner undertakes not to:
- buy keywords containing the Merkatis or Merkatis Monitoring brand, or their variants, on search engines and advertising networks;
- grant any discount, promise or commitment on behalf of Merkatis;
- present itself as Merkatis or as acting on its behalf;
- distribute its link by misleading or unsolicited means.
Any breach may lead to the suspension of the partner and the cancellation of the commissions relating to the customers concerned.
7. Following a customer
Following allows the partner to view the monitoring status of a customer's websites from its partner area, in read-only mode. It is distinct from attribution: an attributed customer is not necessarily followed, and a partner may follow a customer that is not attributed to it. Following has no effect on attribution or on the commission.
Following is never automatic. It is opened by Merkatis or by the customer, who may appoint the partner of its choice, change it or remove it at any time; removal takes effect immediately.
The partner has no access to the customer's invoices, payment methods or settings. It uses this information solely to support the customer and undertakes not to disclose it to third parties.
8. Personal data
Merkatis processes the information provided by the partner (company name, company identifier, contact, bank details) to manage its participation in the programme and pay its commissions. The IBAN is stored encrypted. The details are set out in our privacy policy.
9. Independence
The partner acts independently. These terms create no agency, partnership or relationship of subordination between the parties.
10. Changes
Merkatis may amend these terms. The partner is informed by email at least 30 days before they take effect; if it does not accept them, it may leave the programme. Commissions earned before the change remain due under the terms then in force.
